Who is the Data Controller of your Personal Data?

We have set up appropriate physical, electronic and management procedures to protect the processed personal information. However, because of the inherent open nature of the Internet, we cannot guarantee that communication between you and us or information stored on this Site or on our servers will be completely secure from unauthorized access by third parties. Therefore, we have established rules and policies to determine how your personal information will be processed and protected.

By accessing the Site and booking and / or selecting any of our services listed on the Site, you agree to this Privacy Policy. This Privacy Policy is subject to change and the date of the last change is indicated in the title.

As Data Controller, we process your personal data in accordance with applicable rules on personal data protection, in particular in accordance with General Data Protection Regulation (EU) 679/2016 (hereinafter: the General Regulation) and the Law on the implementation of the General Data Protection Regulation (OG 42/2018).

Types of Personal Data that will be processed, purpose and legal basis of the Personal Data processing

As Data Controller, we process your personal data, i.e. for example, information that can directly or indirectly identify you, in particular by identifiers such as name, surname, address, e-mail address, phone number, photo or recording, IP address and other personal data if you provide them while communicating with us, by making a reservation, by selecting an event that we organize or by taking part at the event we’re organizing (“Personal Data”), especially for the following purposes:

  • Communication with you: when you contact us to confirm the reservation of events we organize, we will process the information you have provided to us so that we can contact you back and act upon your request, that is, to provide you with timely instructions and information regarding the event we are organizing for that you signed up for.
  • Booking accommodation and other events related to the event: when you are interested in accommodation or other services within the events we organize, we collect your information in order to timely and properly arrange, organize and perform the services you have requested.
  • Booking flights by plane to the event venue
  • Your choice of food and drink according to the menus on our site
  • Contacting us by e-mail from your side,
  • Answering your questions and comments,
  • Keeping track of event bookings we organize
  • When you access and make different choices on our Site
  • When we take photos of the events and activities we organize.

Personal data is processed based on your consent, legitimate interest, to fulfill the contractual obligation and based on the legal obligation. Personal Data Processing is limited to the purpose for which it was collected in accordance with the terms of this Privacy Policy.

When we process data based on your consent, we only process personal information that you voluntarily provided to us when communicating with us, to answer your questions, to make reservations and to select the content of events we organize, when selecting from different choices on the site (such as menu selections, drinks , food, etc.). The purpose of the processing is to take steps as per your request e.g. answering questions and comments, receiving and making reservations, communicating about your activities on the site.

We will only collect health, religious or philosophical beliefs and other sensitive information if you voluntarily provide it to us to better serve you or meet your specific requirements and needs (e.g. providing access for disabled people, avoiding serving foods that you are allergic to and similar).

Based on a legitimate interest, we process personal data when you access our Site (IP address) and when we photograph events and activities we organize. If we organize events and other activities during which we will make photos and video recordings of our guests, we will do so either on the basis of a legitimate interest, of which you will be informed before or before entering the video recording / photography area or you will be asked to provide your consent. The purpose of this processing also includes the process of investigating suspected fraud, harassment, physical threats or other violations of the Site’s rules or any suspicious behavior that we consider to be indecent. Participants’ recordings / images at our events are processed for the purpose of promoting the event.

Personal Data Storage

We process personal data only for the time necessary to achieve the purpose of processing the data.

We process the personal data based on your consent and we continue to process it only until you withdraw your consent, while you can object to the processing of personal data based on legitimate interest. We keep processed personal data based on your inquiries, reservations, orders, etc. for a maximum of 6 months from receipt of the same if your reservation is not implemented, otherwise we will keep the data in accordance with the Law on Accounting, while we keep the data of business partners and suppliers until the termination of business cooperation and we do not deliver it to the third parties or ship it to the third countries. In doing so, we do not collect any data of a private nature, but rather data related to the fulfillment of work tasks.

All other personal data that we process based on the performance of a contractual relationship and based on a legal obligation, are stored in accordance with positive regulations in which the time of storage of the same is determined (e.g. Accounting Law). Exceptionally, we will keep your personal information longer than the stated deadlines when necessary to fulfill mutual legal requirements.

After deadlines expire, stored personal data printed on paper will be destroyed safely, such as by cutting or firing, while electronic data will be permanently deleted.

Your Personal Data may be disclosed in the following cases:

  • To the entities required to manage the event – event photography, hotel for arranging accommodation, travel agency and airline, shuttle service, restaurants (menu food and drink) and other entities involved in the event organization.
  • To our Processing Contractor (MPG LTD, Nova Ves 17, 10000 Zagreb) regarding the implementation of the project we are organizing, who will contact you and provide all necessary information regarding the implementation of the events for which you have applied
  • To the entities that maintain our IT systems,
  • To the entities that we have authorized to process Personal Data, which are subject to an appropriate legal obligation of confidentiality
  • To the law enforcement and public authorities, when required by applicable law or in good faith (to protect and defend our rights and / or property or to act in an emergency to protect the personal safety of our guests, employees, the Site or the public),
  • To our legal advisers in case of need to forward information for legal proceedings,
  • To the media outlets and digital marketing agencies for the purpose of publishing photographs in print media, websites and social networks,

 

Transfer of the Personal Data to the third countries 

The data we collect is stored within the European Union (EU) and European Economic Area (EEA) except Switzerland but may also be transmitted and processed in a country outside the EU and EEA, in particular the USA. Any such transfer of personal data will be carried out in accordance with applicable legal regulations. For transfers outside the EEA, we use Standard Contract Clauses, Eligibility Decisions and appropriate safeguards, while any transfer to the US is covered by the EU-US Privacy Shield Agreement, which guarantees adequate protection of personal information.

You can ask us to provide you with the data you provided for archiving in a structured format, in the usual machine-readable format:

  • if we process this data based on the consent you have given us and that you can revoke or to perform the contract and
  • if processing is done using automated processes.
  1. f) The right to object:

If we distribute your data for the performance of public-interest or public-authority tasks, or invoke our legitimate interests when processing them, you may file a complaint against such processing if there is an interest in protecting our data.

If you believe that we have violated Croatian or European data protection rules when processing your data, please contact us to clarify any issues. You are certainly entitled to file a complaint with the competent supervisory authority, which is the Personal Data Protection Agency, Martićeva 14, Zagreb.

Exercising the rights  

If you wish to exercise any of these rights, please contact us using our contact information from these Privacy Policy.

When you apply your demand to exercise your rights, we are required to first identify you and we will request additional information to verify this. This serves to protect your rights and the private sphere.

Should you exercise any of these rights too often and with a clear intent to abuse, we may charge an administrative fee or refuse to process your request.

Tko je voditelj obrade Vaših osobnih podataka?

Društvo Samsung Electronics Austria GmbH, Podružnica Zagreb, Radnička cesta 37b, 10000 Zagreb, Republika Hrvatska, OIB: 71762969400, e-mail: dataprotection.sead@samsung.com (u nastavku: „Voditelj obrade“) poštuje vašu privatnost i obvezuju se zaštititi je tijekom i nakon vašeg posjeta ovoj web stranici (u nastavku „Stranica“). U svrhu zaštite obrađenih osobnih podataka postavili smo odgovarajuće fizičke, elektroničke i upravljačke postupke. Međutim, zbog inherentne otvorene prirode interneta, ne možemo jamčiti da će komunikacija između vas i nas ili informacije pohranjene na ovoj Stranici ili na našim poslužiteljima biti potpuno sigurna od neovlaštenog pristupa trećih strana. Stoga imamo pravila koja određuju kako će se vaši osobni podaci obrađivati i zaštititi.

Pristupom stranici te rezervacijom i/ili odabirom bilo koje naše usluge navedne na Stranici prihvaćate ova Pravila Privatnosti. Ova Pravila Privatnosti podložna su promjenama, a datum zadnje izmjene naznačen je u naslovu.

Kao voditelj obrade obrađujemo vaše osobne podatke u skladu s važećim pravilima o zaštiti osobnih podataka, posebno u skladu s Općom uredbom o zaštiti podataka (EU) 679/2016 (u nastavku: Opća uredba) i Zakonu o provedbi Opće uredbe o zaštiti podataka (NN 42/2018).

Vrste osobnih podataka koji će biti obrađivani, svrha i pravni temelj obrade osobnih podataka

Kao Voditelj obrade obrađujemo vaše osobne podatke i to npr. informacije pomoću kojih vas mogu izravno ili neizravno prepoznati, posebice pomoću identifikatora kao što su ime, prezime, adresa e-pošte, broj telefona, fotografija i snimka, IP adresa te ostali osobni podaci ako ih iznosite u komunikaciji sa nama, rezervacijom i odabirom događanja koje ograniziramo ili sudjelovanjem na događajima koje organiziramo (“Osobni podaci“), posebno u sljedeće svrhe:

  • komunikacija s Vama: kada nam se obratite s potvrdom rezervacije događanja koje organiziramo, obrađivat ćemo podatke koje ste nam dostavili kako bismo Vas povratno kontaktirali i postupili prema Vašem zahtjevu, odnosno kako bi Vam dostavili pravovremene upute i informacije vezano za događanje koje organiziramo a za koje ste se prijavili.
  • rezervacije smještaja i drugih sadržaja vezano za događanje: kada ste zainteresirani za smještaj ili druge usluge u sklopu događanja koje organiziramo, Vaše podatke prikupljamo kako bismo pravovremeno i uredno dogovorili, organizirali i izvršili usluge koje ste tražili.
  • bukiranja letova zrakoplovom do mjesta održavanja događanja
  • Vašeg izbora hrane i pića sukladno ponuđenim menijima na našoj stranici
  • kontaktiranje s Vaše strane putem elektroničke pošte,
  • odgovaranja na Vaša pitanja i komentare,
  • praćenja rezervacija za događanje koje organiziramo
  • kada pristupate i vršite različite izbore na našoj Stranici
  • kada fotografiramo događanja i aktivnosti koje organiziramo.

Osobne podatke obrađujemo na osnovu vaše privole, legitimnog interesa, radi izvršenja ugovorne obveze, te na osnovu zakonske obveze. Obrada Osobnih podataka ograničena je samo za svrhu za koju su isti prikupljeni u skladu s uvjetima ovih Pravila privatnosti.

Kada obrađujemo podatke na osnovu vaše privole, obrađujemo samo one osobne podatke koje ste nam dobrovoljno dali prilikom komunikacije s nama, radi odgovora na vaša pitanja, prilikom rezervacije te odabira sadržaja događanja koje organiziramo, prilikom odabira različitih izbora na stranici ( primjerice odabir menija, pića, hrane i slično). Svrha obrade je u poduzimanju koraka po vašem zahtjevu npr. odgovor na pitanja i komentare, zaprimanje i izvršavanja rezervacija, komunikacija o vašim aktivnostima na stranici.

Podatke o zdravlju, religijskim ili filozofskim uvjerenjima te druge osjetljive podatke prikupljat ćemo jedino ako nam ih Vi sami dobrovoljno date kako bismo Vas bolje uslužili ili zadovoljili Vaše posebne zahtjeve i potrebe (npr. pružanje pristupa za invalidne osobe, izbjegavanje posluživanja hrane na koju ste alergični i slično).

Na osnovu legitimnog interesa obrađujemo osobne podatke kad pristupate našoj Stranici (IP-adresa), kad fotografiramo događanja i aktivnosti koje organiziramo. Ukoliko organiziramo event i druge aktivnosti za vrijeme kojih ćemo fotografirati i snimati goste, to ćemo činiti ili na osnovu legitimnog interesa o čemu ćete unaprijed i prije ulaska u prostor snimanja/fotografiranja biti obaviješteni ili će se od Vas prethodno zatražiti privola. Svrha ove obrade uključuje i postupak istraživanja sumnji na prijevaru, uznemiravanje, fizičke prijetnje ili druga kršenja pravila Stranice ili bilo kakvo sumnjivo ponašanje koje smatramo nepristojnim. Snimke/slike sudionika na našim događanjima obrađujemo u svrhu promocije događanja.

Pohrana osobnih podataka

Osobne podatke obrađujemo samo za vrijeme koje je potrebno za postizanje svrhe obrade istih.

Osobne podatke koje obrađujemo na osnovu privole obrađujemo samo dok ne povučete privolu, dok obradi osobnih podataka na osnovu legitimnog interesa možete prigovoriti. Osobne podatke koje obrađujemo na osnovu Vaših upita, rezervacija, narudžbi itd., čuvamo najduže 6 mjeseci od zaprimanja istih ukoliko Vaša rezervacija nije realizirana u suprotnom ćemo podatke čuvati sukladno Zakonu o računovodstvu, a podatke poslovnih partnera i dobavljača čuvamo do prestanka poslovne suradnje te ih ne dostavljamo trećim osobama niti iznosimo u treće zemlje. Pritom ne prikupljamo nikakve podatke privatne naravi, već one podatke vezane za ispunjavanje radnih zadataka.

Sve ostale osobne podatke koje obrađujemo na osnovu izvršavanja ugovornog odnosa i na osnovu zakonske obveze, pohranjujemo sukladno pozitivnim propisima u kojima je vrijeme pohrane istih utvrđeno (npr. Zakon o računovodstvu). Iznimno, Vaše osobne podatke čuvat ćemo duže od navedenih rokova kada je to potrebno radi ostvarivanja međusobnih pravnih zahtjeva.

Istekom rokova pohranjene osobne podatke ispisane na papiru uništit ćemo na siguran način, primjerice rezanjem ili paljenjem, dok ćemo podatke u elektroničkom obliku nepovratno brisati.

Vaši Osobni podaci mogu biti otkriveni u sljedećim slučajevima:

  • subjektima potrebnima za izvršavanje događanja – fotografiranje događanja, hotelu za organiziranje smještaja, turističkoj agenciji i avio kompaniji za organiziranje prijevoza, restoranima za izradu menija (hrana i piće) i ostalim subjektima uključenim u provedbu događanja.
  • našem izvršitelju obrade (MPG d.o.o., Nova Ves 17, 10000 Zagreb) vezano za provedbu projekta kojeg organiziramo koji će Vas kontaktirati i pružiti sve potrebne informacije vezano za provedbu događanja za koje ste se prijavili
  • subjektima koji održavaju naše informatičke sustave,
  • subjektima koje smo ovlastili za obradu Osobnih podataka, koji su podvrgnuti odgovarajućoj zakonskoj obvezi povjerljivosti
  • službama za provođenje zakona i tijelima javne vlasti kada to zahtijeva mjerodavno pravo ili u dobroj vjeri (u svrhu zaštite i obrane naših prava i/ili imovine ili da u hitnim okolnostima djeluju radi zaštite osobne sigurnosti naših gostiju, radnika, Stranice ili javnosti),
  • našim pravnim savjetnicima u slučaju potrebe prosljeđivanja podataka radi pravnih postupaka,
  • medijskim kućama i agencijama za digitalni marketing u svrhu objave fotografija u tiskanim medijima, na web stranicama i društvenim mrežama, 

Prijenos Osobnih podataka u treće zemlje

Podaci koje prikupimo pohranjujemo unutar Europske unije (EU)  i Europskog gospodarskog područja  (EGP) osim Švicarske, ali se također mogu prenijeti i obrađivati u zemlji izvan EU i EGP-a, posebno SAD-e. Svaki takav prijenos osobnih podataka provest će se u skladu s primjenjivim pravnim propisima. Za prijenose izvan EGP-a  koristimo Standardne ugovorne klauzule, odluke o primjerenosti, odgovarajuće zaštitne mjere dok je svaki prijenos u SAD-e pokriven sporazumom Privacy Shield između Europske Unije i SAD-a, čime se jamči adekvatna zaštita osobnih podataka.

Vaša prava

  1. a) Pravo na ispravak:

Ako obrađujemo Vaše osobne podatke koji su nepotpuni ili netočni, u bilo kojem trenutku od nas možete zatražiti da ih ispravimo ili dopunimo.

  1. b) Pravo na pristup:

Imate pravo dobiti potvrdu o tome obrađujemo li Vaše osobne podatke ili ne, i tamo gdje je to slučaj imate pod uvjetima iz čl. 15. Opće uredbe zatražiti pristup tim podacima.

  1. c) Pravo na brisanje:

Od nas možete zatražiti brisanje svojih osobnih podataka ako smo ih obrađivali protupravno ili ta obrada predstavlja nerazmjerno zadiranje u Vaše zaštićene interese. Molimo da uzmete u obzir da postoje razlozi koji onemogućuju trenutačno brisanje, primjerice radi vođenja pravne obveze kojom se zahtjeva obrada.

  1. d) Pravo na ograničenje obrade:

Od nas možete zatražiti ograničenje obrade svojih podataka:

  • ako osporite točnost podataka tijekom perioda koji nam omogućava provjeru točnosti tih podataka;
  • ako je obrada podataka bila protupravna, ali odbijate brisanje i umjesto toga tražite ograničenje korištenja podacima;
  • ako nam podaci više nisu potrebni za predviđene svrhe, ali su Vam još potrebni radi ostvarenja pravnih zahtjeva ili;
  • ako ste podnijeli prigovor zbog distribucije tih podataka.
  1. e) Pravo na prenosivost podataka:

Od nas možete zatražiti da Vam podatke koje ste nam povjerili radi arhiviranja dostavimo u strukturiranom obliku, u uobičajenom strojno čitljivom formatu:

  • ako te podatke obrađujemo na temelju suglasnosti koju ste nam dali i koju možete opozvati ili radi izvršenja ugovora i
  • ako se obrada vrši s pomoću automatiziranih procesa.
  1. f) Pravo na prigovor:

Ako Vaše podatke distribuiramo radi izvršenja zadaća od javnog interesa ili zadaća javnih tijela ili se prilikom njihove obrade pozivamo na naše legitimne interese, možete podnijeti prigovor protiv takve obrade podataka ako postoji interes zaštite naših podataka.

  1. g) Pravo na prigovor:

Ako ste mišljenja da smo prilikom obrade Vaših podataka prekršili hrvatske ili europske propise o zaštiti podataka, molimo da nam se obratite kako bismo razjasnili eventualna pitanja. Svakako imate pravo uložiti prigovor nadležnom nadzornom tijelu, a to je Agencija za zaštitu osobnih podataka, Martićeva 14 , Zagreb.

Ostvarivanje prava

Ako želite ostvariti neko od navedenih prava, obratite nam se koristeći se našim podacima za kontakt iz ovih pravila privatnosti.

Kad podnesete zahtjev radi ostvarivanja svojih prava dužni smo prvo utvrditi identitet i tu svrhu ćemo zatražiti dodatne informacije radi provjere istog. To služi zaštiti Vaših prava i privatne sfere.

Ako biste se nekim od navedenih prava koristili prečesto i s očitom namjerom zlouporabe, možemo naplatiti administrativnu pristojbu ili odbiti obraditi Vaš zahtjev.
